Course overview
The aim of this course is to develop a theoretical understanding and practical knowledge of both the individual and collective aspects of workplace relations law. Historical development of labour law; contract of employment; flexible working arrangements; subcontracting vs. employment; role of unions; international standards; resolving industrial disputes; Federal and South Australian systems; recent reforms; dismissal procedures and remedies; EEO, OHS, workers compensation.
Course learning outcomes
- Identify key aspects of the Australian workplace relations framework.
- Identify and analyse facts to determine employment status.
- Assess and make recommendations regarding formation of the employment contract.
- Make recommendations regarding the management of workplace behaviour.
- Identify legal issues of workplace discrimination, harassment and bullying.
- Identify Employers' duties and obligations in an employment relationship, and provide recommendations regarding termination of employment and adverse action; and meeting legal requirements during bargaining and collective action.
- Demonstrate Business Enterprise Skills in the context of the Human Resource Management discipline: i) Problem Solving (advanced level); and ii) Teamwork (advanced level).
