Course overview
This course will provide an overview of the law which regulates sporting activities in Australia. Sport and the law (the legal framework), the legal status of sporting organisations including the duties of directors and officers; Sports Tribunals, natural justice and the Court of Arbitration for Sport; the legal liability of participants in tort (negligence) and in criminal law; health and safety issues including risk management; employment contracts including restraints of trade; sports marketing and the protection of ideas; doping and drugs in sport; anti-discrimination.
Course learning outcomes
- Define how the participation in sporting activities may give rise to civil and criminal legal liability.
- Analyse how sporting activities are affected by the law of contract and trade practices law.
- Compare and contrast the legal responsibilities and the risks involved in sports administration and advise upon the options available for the removal of those risks.
- Understand the application of the regulatory system concerning the drug-testing of athletes and the anti-doping authorities.
- Demonstrate Business Enterprise Skills in the context of the Sport and Recreation Management discipline: Problem Solving (intermediate level).
