Course overview
This course will develop student theoretical understanding and practical knowledge of both the individual and collective aspects of employment law. The Australian workplace relations framework; employment status; formation of the employment contract and general terms; managing workplace behaviour; workplace bullying and harassment; employers' obligations; unfair dismissal; bargaining; industrial action; adverse action and unlawful termination.
Course learning outcomes
- Explain how the employment relationship is created and regulated.
- Describe the means by which statute law provides a framework for workplace relations in Australia.
- Identify how an employment relationship can be lawfully terminated and how the risk of an unfair dismissal action can be mitigated.
- Explain the effect for employment relations of Australian laws regarding equal opportunity, occupational health and safety, and workers' compensation.
- Discuss how the law regulates the behaviour of employees and the obligations owed by employers to their employees in light of managerial and ethical principles.
- Communicate and reflect upon effective business and legal strategies and actions arising in typical employment scenarios.
- Demonstrate Business Enterprise Skills: i) Problem Solving (intermediate level); ii) Teamwork (intermediate level); and iii) Written Communication (intermediate level).
