Course overview
This course aims to equip learners with knowledge of the Australian legal system, the key principles of the law of contract, tendering, an overview of the National Construction Code of Australia, an introduction to forms of contract conditions used in the Australian construction industry, subcontracting, latent conditions, performance securities and project insurances. Upon successful completion of the course, students will appreciate the significant role which law, the National Construction Code and forms of construction contract conditions play in the construction process and will have acquired the foundational legal knowledge necessary to understand key provisions in construction contracts in relation to subcontracting, latent conditions, performance securities and project insurances.

Course learning outcomes
- Describe how law is made, recorded, classified and administered in Australia and recognise the differences and interactions between legislation, contract law, equity and law of torts in the context of the construction industry
- Explain how to carry out an ethical tendering process for the appointment of a construction contractor and how construction contracts are formed
- Explain the role, content and format of the National Construction Code, its legal status and why it is important in the Australian construction industry
- Define what is a latent condition on a construction project and discuss the legal rights of a contractor to receive compensation for latent conditions
- Discuss and apply the clauses in construction contracts relevant to subcontracting, performance securities and insurances
