Course overview

This course aims to provide a comprehensive understanding of the concept of "property" within legal frameworks, focusing on its definition and the mechanisms through which the law protects it. Key topics include the differentiation between real and personal property, including choses in action, fixtures, and fittings. The course will also explore the nature and types of estates in land, emphasising their legal implications. Additionally, students will gain an outline of the Torrens system of land titles, examining its operational framework and significance in property law. 

Course learning outcomes

  • Apply the fundamental principles of property law from a theoretical and practical perspective
  • Explain the Torrens system as it applies in South Australia and Australia
  • Describe the concepts which underlie the reasoning for the protection of legal and equitable interests
  • Critically analyse the mode of obtaining interests in property in comparison with previous methods
  • Resolve property problems by identifying legal issues and by applying property rules and principles
