Course overview
This course develops students knowledge of the impact of laws regulating workers and their workplaces in the Australian context. The major areas of employment law include the common law and statute law. There are many 'sources' of employment law, which set out the rights and obligations of employees and their employer. An employer in Australia has many obligations arising mostly from federal law but also from state law and the common law. This course investigates these laws in terms of, inter alia, employer-employee duties, termination of employment, workplace bargaining and industrial action. Students will identify employment law issues as well as provide analyses and recommendations to solve workplace problems. Students are assessed through problem-solving exercises.
Course learning outcomes
- Differentiate between the creation of different types of workplace relationships and the legal rights and obligations arising from those relationships with readings and class activities around the topics by completing the core requirements of this CLO in problem-solving exercises
- Identify how Australia's workplace relations framework creates a variety of rights and obligations at work with readings and class activities around the topics by completing the core requirements of this CLO in problem-solving exercises
- Interpret and apply legal obligations surrounding termination of employment with readings and class activities around the topics by completing the core requirements of this CLO in problem-solving exercises
- Analyse the impact of employment obligations upon employers, including work health and safety, workers compensation, equality of opportunity/discrimination and adverse action legislation with readings and class activities around the topics by completing the core requirements of this CLO in problem-solving exercises
- Develop lawful and ethical recommendations for effective management strategies relating to aspects of employment law with readings and class activities around the topics by completing the core requirements of this CLO in problem-solving exercises
- Assess legal requirements to ensure lawful enterprise bargaining processes and lawful industrial action with readings and class activities around the topics by completing the core requirements of this CLO in problem-solving exercises
