Course overview
This course will provide students with contract knowledge and analytical skills for commercial management of construction projects in relation to procurement, tendering, contract formation, payment, time and variations. The course includes: Construction procurement methods. Tendering. Contract formation. Introduction to forms of construction contract conditions including nature of contract, discrepancies in contract documents, service of notices, counting of days, and role of superintendent. Time in construction contracts including extensions of time and delay damages. Payment under the contract. Building and construction industry security of payment legislation. Variations.
Course learning outcomes
- Apply theoretical knowledge and skills to analyse the use of various procurement routes for commercial construction projects.
- Investigate and critically evaluate key provisions of widely used standard forms of contracts.
- Apply the knowledge and principles of construction law to resolve disputes typically arising from commercial construction projects.
- Critically review and advise on construction law case scenarios in light of express contract clauses, relevant legislation and the common law.
