Course overview

This course will provide students with contract knowledge and analytical skills for commercial management of construction projects in relation to latent conditions, subcontracting, insurances, defective building works, security, contract termination and insolvency, claims and dispute resolution. The course includes Site conditions and latent Conditions; Defective building works; Indemnities and insurances. Subcontracting; Contract security; Contract termination and Insolvency; Dispute resolution clauses in construction contracts; Claims and disputes; Litigation and arbitration; Alternative dispute resolution methods.

Course learning outcomes

  • Apply theoretical knowledge and skills to analyse various types of construction claims typically occurring on construction projects and assess parties' legal entitlements under the contract provisions, relevant legislation and the common law.
  • Investigate and critically evaluate the dispute resolution provisions provided in widely-used domestic and international standard forms of construction contract.
  • Critically review, compare and contrast the characteristics and suitability of formal dispute resolution methods, alternative dispute resolution methods and dispute avoidance procedures which are used domestically and internationally in the construction industry.
  • Apply dispute resolution skills for settlement of construction disputes.
