Course overview

The aim of this course is to provide students with knowledge and understanding of the Australian legal system and the key principles of construction law providing a foundation to manage construction projects. In this course the student will typically study the following topics: Introduction to the Australian Legal System; Sources of Australian Law; Contract Formation - Offer and Acceptance; Consideration and Estoppel; Tendering; Standard forms of Construction Contract, Contract Formation and Nature of Contract; Payment under construction contracts; Building and Construction Industry Security of Payment Legislation; Defective Works; Termination of construction contracts; Insolvency.

Course learning outcomes

  • To describe the Australian legal system and understand statutory controls and their influences on commercial practices.
  • To differentiate key construction legislation to provide appropriate advice to all stakeholders.
  • To demonstrate understanding of the key principles of contract law and law of tort when applied to construction projects.
  • Critically appraise and advise on, from a legal standpoint, case scenarios relevant to statutory and contract law on construction projects.
