Course overview
This course aims to equip learners with knowledge of the Australian legal system, the key principles of the law of contract and torts, the various forms of contract conditions used in the Australian construction industry, key construction contract administration concepts and terminology and subcontracting. Upon successful completion of the course, students will appreciate the significant role which law plays in the construction process and will have acquired the foundational legal knowledge necessary to understand key provisions in construction contracts and progress their further learning with respect to construction contract administration.
Course learning outcomes
- Describe how law is made, recorded, classified and administered in Australia
- Recognise the differences and interactions between legislation, contract law, equity and law of torts in the context of the construction industry
- Explain how to carry out an ethical tendering process for the appointment of a construction contractor and how construction contracts are formed
- Demonstrate an understanding of construction contracts and their application to projects
- Distinguish between the different types of subcontractors engaged on construction projects and how they are appointed
