Course overview

The course provides students with in-depth knowledge and understanding with respect to key areas of construction contract administration including latent conditions, performance security, project insurances, time, defective works, contract termination, insolvency, claims and dispute resolution.

Course learning outcomes

  • Describe the different types of performance securities & insurances typically required on construction projects and discuss the clauses in construction contracts relevant to performance securities and insurances
  • Define what is a latent condition on a construction project and discuss the legal rights of a contractor to receive compensation for latent conditions
  • Identify and explain the clauses in construction contracts which deal with time & defective works and discuss associated case law and legislation
  • Explain the rights of parties with respect to termination of contract and insolvency under construction contracts and discuss associated case law and legislation
  • Distinguish between extra-contractual claims & claims under construction contracts and describe contractual dispute resolution procedures & the alternative dispute resolution methods commonly used in the construction industry
