Course overview
This course will provide students with an understanding of: traditional procurement methods and standard forms of contract for construction projects; tendering processes for construction projects; time, payment and variation provisions commonly found in standard forms of construction contracts; and building and construction industry security of payment legislation. Construction Project Lifecycle; Traditional procurement options; Tendering and contract formation; Standard forms of building contracts; Responsibilities of Employer, Contractor and Superintendent in construction contracts.; Nature of contract (bill of quantities and schedule of rates); Practical and final completion of construction contracts.; Progress of construction works and programming; Extensions of time and liquidated damages; Progress payment claims and certificates.; Provisional sums; Set offs; Building and Construction Industry Security of Payment Legislation; Project Bank Accounts; Variations.
Course learning outcomes
- Evaluate the traditional procurement methods for construction projects.
- Summarise the key legal responsibilities of the parties to a construction contract.
- Critically analyse from a legal perspective the express nature of contract, time, payment and variations contractual clauses to be found in the AS 4000 standard form general conditions of construction contracts and relate to the contract administration procedures used on construction projects.
- Critically review and advise on construction contract administration case scenarios in light of express contract clauses, relevant legislation and the common law.
